THE
OPINIONS OF UMY LAW STUDENTS ON THE NEGATIVE IMPACTS OF DOMESTIC VIOLENCE
TOWARDS CHILDREN
A. Introduction
Indonesia is a unitary state that has basis in law
as well as basis in governance. As a state of law, all actions taken by the
residents will be bound, regulated, and protected by the law in Indonesia. The
law in Indonesia will also be applied to all citizens of Indonesia, although thes
are located in the territory of another country. The protection are provided by
the laws of Indonesia to provide security for the entire community. But lately
emerging new violence is violence on minors. Children are young successor to
the ideals for the national struggle and have a strategic role to ensure the
continued existence of the nation in the future. Therefore, everything that is
done for there good were treated for the good of the whole community. But with
the violence commited by adults to children under age can adversely affect the
child's development. All treatments in the form of violence can damage children
in both physical and mental. The condition of the woun will continue to be
taken by the child to adulthood causing the development process not optimal due
to human resources to get the negative impact of being a victim of violence as
a child. The law in Indonesia set up and establish laws which is used as a protection
for children under age from various acts
of violence that threaten their safety.
According to umy law students, if violence is
witnessed every day the child is likely to be traumatic, tend to be quiet,
often angry and cry. over time, thes mas see their parents shout or punch each
other, which will make the child confused. In fact caused by his parents
behaviour, it is not impossible if he would get angry with others who do not
necessarily have to do with him. In addition the child may imitate the behavior
of the parents in solving a problem if the child is already married. This
happens because children acquire a model in how to solve a problem from their
parents. For example, when the child saw his parents arguing and then saw that
one of the parents uses violence, the experience will always give an
impression that it can be one of the reference to do when solving problems.
Under these circumstances, the phenomenon of domestic violence can be
"contagious" to other people so that domestic violence will never
disappear or family environment will always threaten every family.
Santi (2012) considers violence against children is
not just a personal problem. If it only affects a few of children it, can be
tracked on the psychological causes of the individuals involved. The solution
can also be done individually. Providing psychological therapy on both the
perpetrators and the victims which may
be quickly completed.
B. Literature
review
Domestic violence is an activity in which the actors
(who are members of households) attack someone who is also a member of the
household. Violence means violence against children committed by parents
against their children.
According
to Law No. 23 of 2004 on the elimination of domestic violence, Chapter I,
Article 1, states that: domestic violence is any act against a person,
especially women, resulting in the emergence of misery or suffering physical,
sexual, psychological, and or negligence of household including threat to
commit acts, coercion, or unlawful deprivation of liberty within the domestic
sphere.
Judging
from the social psychological aspects, Adorno (in Azevedo & Viviane, 2008:
21) explains that:
Violence
is a form of social relations ... Clearly, the violence shows social skills,
ways of life imitating models of behavior in the social environment and applied
in a particular situation in a lifetime ... In addition to the violence
seseorag the show a social class, but it also shows quality of interpersonal
relationships. Interpersonal relationship is like the relationship of husband
and wife, both adults and children, even other categories like someone with an
object ... Violence is a permanent threat because it resulted in suppression,
cancellation or even death.
C. Methodology
This research is designed with a descriptive method
by interviews, opinion and outlook from umy students.
In
the interview, the researcher to the interviewee about an introction to the
problems the introduction is attached in the appeadiy. Before the interviewer
is held, the interviewer gives a brief explanation about what the research is
all about. The brief information about what attached in the appendix.
"This
research is important because it reveals how the process of adaptation to the
child's brain to violent behavior in the family, as well as its impact in the
future," said McCrory as quoted by the Daily Mail, Monday (5/12).
The
research is conducted in umy. The respondents are tree students from law facuts
of umy. The all of question based on the
three based question:
1.
What are the sycology impacts the
forward children’s caused by domestic violece?
2.
Are the punishmen on domestic violence
appropriate,yet?
D. Finding
and discussion
After
the data are collected and based on the data, all respondents disagreed with
the punishment diIndonesia. demonstrated their disapproval by reason.
·
First: Violence is a permanent threat
because it resulted in suppression, cancellation or even death and the
punishment should also be worth a minimum of 20 years imprisonment.
·
Second: they assume that the sentence
was in Indonesia have not been so good and effective because the punishment can
not deter most violent offenders and is conducted by a husband against his wife
and will pisikologi impact also on their children.
·
The Third: the children who are often
seen bickering parents, especially when accompanied by physical violence will
be more alert to face the danger signal itself. Side effects, children also
have a high risk of anxiety and depression in adulthood.
I.
Adequate punishment for perpetrators
penalties
provided by law enforcement officials should be a deterrent, but it does not
seem evektiv because it is caused by domestic violence is very much impact,
especially for the victims themselves and their children who see their parents
to violence. if the violence he witnessed every day may be traumatic, tend to
be quiet, often angry cry. And from time to time be general, meaning not only
see their parents shout or punch, but when he saw that the others were doing.
In fact it is not impossible he would get angry with others who do not
necessarily have to do with him. In addition to traumatic and young children
tend to imitate the behavior of their parents going to menyelaesaikan matter if
the child she was married. This happens because children acquire a model in how
to solve the problem. For example, he sees his parents arguing and then saw one
of the parents using violence, the experience will always imprint on him, and
become one of the reference when solving problems.
Some
statemen from respondent :
“Kalau menurut saya hukuman bagi
pelaku kdrt ini belum begitu efektif sebab dampak yang ditimbulkan oleh korban
kdrt ini tidak sebanding dengan hukuman yang diterima oleh pelaku, seperti
kekerasan, pemukulan, fisikologinya juga terganggu”.

II.
Man has always been a perpetrator of
domestic violence
Most
of the people in general realize that domestic violence is not such a great
cause, whatever the reason for trying to justify it. But on the other hand, the
number of domestic violence cases rising from year to year, which is almost all
done by the husband to his wife. Then comes the question: Why would a man have
the heart to hurt her own choosing as a life companion, who is also the mother
of his children? Should not the husband's role as a protector, and not vice
versa
It
is said that men often do violence to his wife constituted with a family
background where his father once too often to violence. But in subsequent
studies it proved irrelevant. Most of the perpetrators of domestic violence
have a dependency on alcohol, while another part comes from a family background
that is less capable with minimal education.
But
it turns out it was not relevant and can not be justified as a valid reason men
abusive to his wife. Better Health Channel website says, the researchers found
that men who commit domestic violence often experience this:
*
Using physical and emotional abuse to control his family. Labeled
"bad", "bitch", "stupid", and so his wife or
children have a form of emotional abuse.
*
Convinced that they have the right to behave in any way they choose while in
his home.
*
Thinking that a real man should be tough, strong, and became head of the
household. Therefore, they also believe that they should take all decisions,
including how much money should be spent.
*
Believe that man the right to demand sex from his partner.
*
They are not responsible for their actions and assume that the wife or the
environment that provoke it.
*
Making excuses about perpetrating violence, such as the blame alcohol or stress
because of work.
*
Claiming to lose control when angry to his family, but was able to control his
anger when he was in between others. They tend not to use violence in other
situations, such as when you're with friends, your boss, or coworkers.
*
Trying to blame others if there is justification or denial of the violence they
are doing or the effect of violence against women and children.
The
views and mindsets that undermine the existence of women in a family is a major
factor in domestic violence. And this mindset is formed in its infancy men are
in their environment, so that nature likes to domestic violence is not a trait
easily removed, especially when it becomes a habit.
Some
statemen from respondent:
“Karena seorang laki-laki itu dalam
segi fisik kuat sehingga kdtr ini sering dilakukan oleh laki-laki”.
(intr

“Perempuan itu lemah dari segi
pisik dibandingkan dengan laki-laki”

E. Conclusion
Solutions
to prevent domestic violence
The
correct solution for the domestic violence meminimalisirkan That could change
if there is modernization. What is meant here is not the modernization of life
style, but a more substantive. For example, by changes in the values of
humanity, mindset, knowledge insights and important aspects lainnya.Tentu there
are external factors that affect, for example, exposure to the media. If fixed
media presentation featuring women as a commodity to be exploited only by men,
that means there is a process of planting mindset. Because the displays on
television, for example, a justification that men can commit violence.
Could
have been the cause of economic factors. If there are economic problems and
there is no agreement, then there is no communication to give birth the way
out, it could happen tangga.Kuncinya violence in the home is on communication.
If there is no communication, stereotyping and prejudice are born great between
the two sides, more than faith to resolve the problem themselves. So the
possibility of mutual openness in the household is the right solution to
overcome them. In the sense of trust between members of the family in every
way.
